These Terms govern your use of AtPigeon — domain email hosting provided by AtPigeon BV. By creating an account or paying for a subscription you agree to them. Please read them carefully.
“AtPigeon”, “we”, “us” means AtPigeon BV, a private company registered in the Netherlands, with offices at Keizersgracht 421-A, 1016 GC Amsterdam. You can reach us at [email protected].
“You” means the person or organisation that creates an account or signs a subscription. If you sign on behalf of an organisation, you confirm that you are authorised to bind it to these Terms.
AtPigeon provides hosted email infrastructure on customer-owned domains: SMTP receive and send, IMAP access, webmail, an admin console, mailbox and alias management, and shared per-domain storage. The exact features included in your plan are listed on the pricing page and inside the admin console at the time of purchase.
We may add, change or remove features over time. Material changes that reduce the substance of what you pay for will be announced at least 30 days in advance.
AtPigeon is for legitimate human-to-human and transactional email on domains that you control. You agree not to use the service to:
We monitor only what we have to in order to keep the service running, fight spam, and meet legal requests. We don’t read your mailbox content for advertising — there is no advertising.
Subscriptions are billed per domain on a monthly or annual cycle, in EUR (or the currency we display at checkout). Payments are processed by our reseller of record, Paddle.com Market Limited, who is the merchant of record on the receipt.
You can cancel a subscription at any time from the admin console. Cancellation takes effect at the end of the current billing cycle — you keep service through the period you’ve already paid for. We don’t charge an exit fee.
Our refund policy is on a separate page: Refund Policy. It is incorporated into these Terms by reference.
You own your mailboxes, messages and metadata. We store and process them solely to provide the service. How we handle personal data — what we collect, why, who processes it on our behalf, and the rights you have under GDPR — is described in our Privacy Policy.
You can export your mail at any time over IMAP. After your domain is closed we keep mail for 30 days for accidental-recovery, then permanently delete it.
AtPigeon and its software, brand and documentation are owned by AtPigeon BV. We grant you a non-exclusive, non-transferable right to use the service while your subscription is active. We don’t claim any rights in the email content or attachments that you store on the service.
We target 99.9% monthly availability for SMTP receive, IMAP and webmail (excluding scheduled maintenance announced 24h in advance). If we miss that target on a paid plan, you can request a service credit equal to the pro-rata downtime by writing to [email protected] within 30 days of the incident.
We provide the service with reasonable care and skill. To the maximum extent permitted by law, AtPigeon is provided “as is”. We don’t warrant that the service will be uninterrupted or error-free, or that every message will be delivered to or accepted by every third-party mail provider.
Nothing in these Terms limits liability for death, personal injury, fraud or any other liability that cannot be limited under Dutch law. Subject to that, our total liability arising out of or in connection with the service is capped at the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, lost profits, lost data, lost goodwill, or business interruption.
We may suspend or terminate your account if you materially breach these Terms (including the Acceptable Use rules), if a payment stays unpaid past the grace period, or if we’re required to do so by law. Where it’s safe and lawful, we’ll give you notice and a chance to fix the issue first.
We may update these Terms when the service changes or when the law does. We’ll post the new version with a new effective date and email you at least 30 days before any material change takes effect. Continuing to use AtPigeon after that means you accept the update.
These Terms are governed by the laws of the Netherlands. Disputes go to the competent courts of Amsterdam, without prejudice to mandatory consumer protections you have under your local law.
